After hearing everything the past two days I think #1 is more likely. I don't think JonBenet was killed on purpose, I think it was an accident and they didn't want the stigma associated with it so they covered it up. It was never brought to trial because of the Ramsey's influence and without examining the evidence with modern tech we will never know (unless one of the two guys confesses or rats the other out).
Even in the dark he would not mistake someone who is 4feet tall as an intruder. It is far more likely Burke swiped her with the flashlight he had next to him at the table while he was eating pineapple. It's possible he dragged her downstairs to the train room (he seems to lack the emotion necessary to understand his actions were very serious)and then realized she was not moving thus poking her with the metal rod but blood at that point had stopped flowing as the examiner on cBS stated. In his typical aloof fashion he headed back to bed only for Patsy to come down to get the suitcase and find her (or John). That explains the "what did you find?"That he asks on the phone. They didn't wake him because they didn't want to know the details.Patsy and or John realized who had hurt her and from there staged the scene. They knew he brought that flashlight down so they wiped it clean including the batteries. Patsy's paint supplies were nearby and from there the night went on. For some reason though they decided to call 9-11 versus risk taking the body with them on the trip that morning. I'm thinking t would've been too hard to find a place to place her or they couldn't bear to leave her outside somewhere. John's urgency to fly was to get Burke as far away from the house as possible. They truly loved those kids. Kids make mistakes and I am betting they didn't find her until 45 minutes - an hour or so after Burke hit her. That is why 9-11 wasn't called right away.
