But ... there is a silver lining. It's pretty obvious at this point that Trump and others around him have committed crimes. Whether or not Trump himself testifies, there's a good chance Special Counsel Mueller will have enough evidence to bring more indictments, maybe even against Trump himself. So while Trump may be willing to accept the political heat and just general appearance of guilt and weakness that comes from pleading the 5th, that doesn't shield him from getting charged with crimes.

Mueller won’t seek an indictment of a sitting president. That battle would only result in legal proceedings and delay. He will lay out his evidence to the House for Articles of Impeachment.

Of Trump testifies before a grand jury, it would likely not be in secret. We won’t know what is said. Except Trump will be instructed not to talk. And will then talk.

1. Trump has two options. Either be interviewed in accordance with some ground rules negotiated by counsel or face a subpoena. Trump’s stunt before leaving for Davos, together with this bombshell, just gave away most of the little leverage that he might have had.

2. Grand jury proceedings are secret and the SC isn’t going to leak any testimony.

3. Trump doesn’t want to have to swear an oath and testify before a panel of DC residents who he considers beneath him, particularly in the wake of his trip to Davos. In his mind, he’s a brilliant world leader.

4. Trump has no real options. He can reign ignorance when confronted with testimony and other evidence. But he’s the smartest man in the world with a good brain and the best words. He can take the Fifth. However, he claims he’s cooperating fully and it pretty much seals doubt about his innocence. He would claim witch hunt, Mueller is mad about some greens fees, wilmerHale, etc. Or he can ignore the subpoena and take his chances that the House doesn’t impeach in the short term. This pretty much guarantees Congress flips in November. Finally, he can try to negotiate a plea in exchange for resigning. Meanwhile, Javanka and Don Jr. are left twisting in the wind.

All of these are terrible in terms of our nation.

If they share the same lawyer, the probably have a joint defense agreement. Otherwise, massive conflict of interest.
