The ruling in this particular case suggests that the wife of the alleged shooter may have adduced persuasive evidence of him not being safe for the children to be around. Nonetheless, it is never for the non-movant to prove anything. They may need to rebut a prima facie case, but it is the party seeking relief that has the burden of proof, showing unfitness, etc.
