Yes. Because yelling is not harmful. You cannot assault a person in the name of a future crime that has not been committed yet.

Repeatedly yelling that you are going to kill someone and don't care what happens should not mean that potential victims have to remain quiet and polite while waiting to be assaulted, raped, killed, etc.

Well he's just been indicted by a grand jury--which suggests that not everyone agrees with you--and his case will move forward to trial. Let's wait and see what a jury decides, shall we?
