If it's true, he would have the burden to prove, as a defense, that he was experiencing a psychotic episode and did not know the difference between right and wrong at the time of the crash.
Just having a mental illness is not an automatic defense that absolves someone of criminal liability. He would have to prove he was currently experiencing symptoms, not just that in high school or in the army he did. It's pretty complicated.

What do airbags not going off have to do with anything? I hit a guy at 40 MPH who was making an improper left hand turn so hard it put him in the hospital with a head injury (yes I felt badly and he recovered; he was cited at the scene). My airbags did not fire.
