Yes. Because yelling is not harmful. You cannot assault a person in the name of a future crime that has not been committed yet.

Well he's just been indicted by a grand jury--which suggests that not everyone agrees with you--and his case will move forward to trial. Let's wait and see what a jury decides, shall we?

A grand jury indictment means nothing. Have you ever heard of the saying that you can indite a ham sandwich?

Cite the witness statement that shows he was violent on the train the day he was killed.

There were multiple 911 calls before Penny rook him in a chokehold.

How often do you think New Yorkers call 911 on the subway about nonviolent people?
