The victim had not assaulted anyone on that train.
If someone is repeatedly threatening to kill and shouting that he doesn't care abiut the consequences, is your opinion that potential victims should wait for a hit to the face or a knife or gun to be pulled out before doing anything?
Yes. Because yelling is not harmful. You cannot assault a person in the name of a future crime that has not been committed yet.

Mr. Penny took the heroic action to prevent one single innocent victim that day.
We need more men who have the guts (and strength!) to protect women and children trapped with a raging, towering lunatic threatening to murder them.

Well he's just been indicted by a grand jury--which suggests that not everyone agrees with you--and his case will move forward to trial. Let's wait and see what a jury decides, shall we?
A grand jury indictment means nothing. Have you ever heard of the saying that you can indite a ham sandwich?

Not a single witness on that train said Daniel Penny did ANYTHING inappropriate. Daniel Penny is a GREAT American HERO for saving the lives of the women and children on that train. One of the (black) ladies on the train SAID so. The perp threatened to KILL her.

I said no apologetically, but he tried to attack me and steal my bag. He spit on me. I screamed as loud as I could. If I had a weapon, I would have used it. He could have easily killed me. I am very ill and it would not take much from a lunatic homeless vagrant to kill me. Sorry, I'm not dying for these people, they have already taken enough from me.
But he didn't kill you did he? And if you had a weapon you would most likely have killed a man for no reason other than that you were scared.
People are allowed to defend themselves when attacked. Someday you'll learn that life is fleeting easy to extinguish, and those of us going about our business are tired of being bullied and hurt by people like you.
Uh, there is nothing to indicate that PP is violent. You, on the other hand, seem to have a hair-trigger impulse towards it.
Justice does not need to be violent. You, on the other hand, are excusing any violence short of murder, which is despicable.
Cite the witness statement that shows he was violent on the train the day he was killed.
There were multiple 911 calls before Penny rook him in a chokehold.
How often do you think New Yorkers call 911 on the subway about nonviolent people?
