The problem with this is that sometimes YOUR insurance company will declare you 💯% not at fault for an accident - yet the other motorist’s insurance may only accept partial responsibility.

Then the case may head into arbitration.
Which could take months.

Sucks.

In my limited experience with only one major auto accident, you can talk to the insurance company an negotiate some. If you threaten a lawyer you can get them to give you more. If you hire a lawyer you can get a whole lot more but the lawyer will take 1/3. So you might be able to get $10k or $15k pain and suffering which would net you $6.6k or $10k total while just calling and threatening this they may offer you a few thousand not to go through with it (you'll have to sign a paper saying it's your full settlement for pain and suffering). I'm sure you would also be able to get more for the car, the insurance repaired my car even though it was well over 10k for the repairs so I didn't go through that and don't really have any help there.

First you need to understand something. You are going to get the value of your car not the cost to get another one.

Negotiation techniques depend on the carrier you are dealing with. Different companies have different philosophies.
