Somehow this doesn't sound like the full story...anyway here is my general advice for tickets:

Go to court. The cop may not show up, in which case dismissed. If they do show up, the prosecutor can't possibly try each ticket or the docket would run for 7 days and they have 3 hours. 99% get settled. So, you can do a couple of things. 1. Wait it out and see if cop shows and wait for your turn, or 2. seek out prosecutor in advance and see what you can do for bargain. Usually with little to no record you can bargain for no points and a quick costs+reduced penalty. Maybe you can get the toll paid and show a receipt, and get out with just costs.

Definitely print out your full EX pass history, be sure to bring it in folders ready to introduce. And, can't hurt to print out maps, pictures, google earth, etc. Chances are you'll get kicked with costs and fine in trial, and a judge just wants to move along. The system is designed for people to simply pay and not show up. And no need to stress - your fine can't get any larger than the ticket.

Wow, OP, I have never heard of this happening. What state was this? EZPass tracks all the license plates that come through tolls, and if the transponder fails, then they can match up license plates with EZPass accounts after the fact. So I don't believe it's a failure to pay issue, bc EZPass would get their money eventually.

What does the ticket actually say? Make sure you check your EZPass account bc you may have actually paid (after the fact).

a ticket looks like a court summons---but unless it is dui or reckless driving, etc. that does not mean you have to go to court. read the entire ticket front and back. if you pay or settle it ahead there is no court appearance.

Technically speaking, a ticket is a court summons - it's just one you can get out of by paying the fine (which is technically a guilty plea).

I showed him my EZ pass. I told him I have no clue why it didn't work. Is this worth being summoned to court? What will they do to me/ask me while there?

Were you speeding or are you going because your ez pass didn't work?

I would bring copies of your ex pass account showing that it had a credit balance and that the credit card connected to it wasn't expired. If you forgot to reload your ex pass after a card was cancelled or expired, then I think you are SOL.

I drove through a toll booth and my Ez pass did not work!

A cop pulled me over and gave me a ticket where I am summoned to go to traffic court. I am petrified. I have never even had a speeding ticket! What do I do?
