Don’t let anyone tell you he can’t get an IEP if he’s performing at or above grade level. Look at the websites for Fairfax Twiceexceptional and Westlaw.

Reviving this thread because we are at this juncture with my 4th grade DC. We have a 504. I want an IEP, focused on social skills/social communication (big impact on ability to participate in group work/group projects this year). I anticipate seeing reading comprehension issues this year as social language/inference becomes a greater part of the writing. He already receives OT through the 504.

Any thoughts? Meeting is tomorrow and I want to avoid being told that he "can't" qualify for an IEP with deficits that are primarily social skills/social communication (social/emotional/behavioral).

Depends on the elem. school but some will try to convince you that you only need a 504. Fight like a tiger for an IEP - there is a reason that they don't want you to have one . . .

I would recommend highly that you consider getting a advocate to help you from the beginning. The school is incented to deny services as their resources are limited but they have your DS for 7+ hours per day and even if you can afford services outside of school, your DS may suffer needlessly at school without proper services. That is what happened to us - DC suffered while services denied.

^^PS if your kid has ASD it is like you need some sort of service such as speech, OT or specialized instruction.

An IEP is for services and accomodations, while a 504 is just for accommodations. In most cases it's good to ask for an IEP to see if you quality for services, even if you think you'll just end up with a 504. Also, the IEP has statutory deadlines for response so it prevents foot dragging by the school.

Not OP, but I could have written the OP. How do you know whether to ask for a 504 or an IEP?

If its affecting him in school, he will likely qualify for an IEP.

My child got an IEP immediately in K with a tentative diagnosis of ADHD as well as developmental delays, but that was in MCPS.

My HFA child is mainstreamed with an IEP. He has goals in reading comprehension, written expression, pragmatic speech, and social skills. For a while I be had OT, but no longer.

Your first step is to send a written request to the principal asking for an IEP evaluation. The IEP or 504 depends on the areas of educational impact. There should be some recommendations in your diagnostic report, but you'll have to work it out with the school. Most ASD kids I think are eligible for IEPs.

DS just diagnosed. How will DCPS view this, will we need an IEP or 504? I dont know what's next, DS is in 2nd grade.
