I think he's just asking if that's what this is, not looking to use it as a reason in an at-fault divorce.
I think he's planning to accuse her of it and try to make her feel bad (and possibly threaten your standard legally no-fault divorce but make it clear it actually is her fault), and wants his terminology right.
