You can ask if they are re-hirable but 99% of the time the company will say yes. You may be able to get away with having the candidate sign a release form that would disclose if they were voluntarily or involuntarily terminated from their previous position. But that would be a pretty slippery slope if you found out they were fired and then did not hire them.

I think you can still ask if a company would rehire the person.

Most companies wouldn't disclose that info these days, only confirm dates worked, title, and sometimes salary.
