In Virginia, you cannot obtain a police report. You can go to the clerk's office in which the alleged offense happened and get a copy of the warrant as long as the accused and complaining witnesses are both adults. If the accused is a minor, you can't look at the file if the charge is a misdemeanor. You can see a felony warrant if the accused is a child.

My husband was a Domestic Violence Officer in Virginia before he retired recently, and he was not allowed to give out reports to anyone except the court. No one could walk into his office and just get a report from him.

It’s not going to protect white women either. DH learned that when his sister was murdered after getting a restraining order.

In Virginia, it's kind of hard but you can get at least basic info from most court web sites (if he was charged, not just arrested).

Have you tried beenverified.com - they seem to have some good information and you may even learn about legal issues of which you were not previously aware.

Also-- while I sympathize with someone who does not want to testify against an ex-abusive spouse, the law is you have to. You don't just "LISTEN and don't ask anymore questions." If that were the case-- do you think anyone would testify against HARDENED criminals???

NP - the bolded depends on what kind of action she's being asked to testify for. Criminal? While he's in jail? Sure, this could be true. DV Protective order? No ones going to protect her after, and there are all kinds of ways for him to retaliate if he chooses (and gun purchase loopholes too). When a woman says that testifying would endanger her and her child, you LISTEN and don't ask any more questions. (I'm a DV survivor, share custody with my former abuser, and I get it)

Doesn't matter if you aren't married now. Spousal privilege is meant to protect the harmony of the marriage.

What state OP? In DC the arrest affidavit of a case that was prosecuted is available at the clerks office in the courthouse. The “police report” is a different document called the PD 251. That is available at any police district but you need to have it identifiable through the CCN number. They are free.

All arrests are public. Just start googling. If you find the county where the arrest occurred, search the county dockets most are online. Once you find them. You need to request certified copies from the county for it to be admissible in court.
