Unless that one parent has sole legal custody, NO. Even if parents are divorced and the child lives mainly with one of the parents, the two biological parents general have joint legal custody. Courts rarely award sole legal custody to one parent-- it is usually reserved for situations where one parent is a child molester, is in prison, etc.

Legally, except in these unusual situations, both parents must agree on a schooling option unless a curt orders a particular placement.

Are you currently in a relationship with the other parent? If so, work it out with the other parent, or if you can't, go to couples/marriage counseling.

If you are not currently in a relationship with the other parent, is there a custody agreement? If so, what does the custody agreement say?

If you are not currently in a relationship with the other parent, and there is no custody agreement, then either work it out with the other parent or get a custody agreement.

OP! Hello If your child has passed 6th grade and was an honor roll student, can one parent determine if that child should repeat the 6th grade again and be homeschooled without the consent of the other parent? Is this legal? Could this be a legal issue?
