The berries are actually really tasty. Do you think you could learn to like the tree if you start harvesting the berries? I love having edible plants in my yard and would consider it a huge bonus if I got to enjoy them without going to the effort and expense of planting them.

I actually don't think the OP is making up problems. I grew up in a town with a lot of mulberry trees and during berry season, the sidewalks were covered with berries. It was impossible to avoid stepping on them unless you walked in the street.

you can trim/remove any portion of the tree over your property line. if that kills the tree, that's ok.

It will be over in a few weeks. I have one hanging over my yard from the common land outside my fence. The branches were too close to my windows (that's how big it is) so we had the branches cut that are over the yard. Your problem, not his.

how about just training your kid to NOT walk on the berries? now there's a thought. Oh, and you should cut the tree back so that its over your property. Your neighbor surely has the money to do it but is telling you he doesn't so that you'll back off, because he knows its not his responsibility. Its passive-agressive on his part but he's in the right, you're in the wrong.

Mulberry tree attracts a variety of birds. My neighbor has one and I do have to rake the leaves in Fall, but I do not mind because of the bird watching opportunity.

Bad idea. There are too many irresponsible, uneducated parties trying to take on the role of Captain Neighborhood, only to find themselves in deep with local and national environmental agencies. I would not chance it.
