I agree - you are firing your nanny. It's ok to use that word.

She will apply and can put whatever she wants on the form and then it is up to you to contest it or not.

How is this a layoff? The requirements of the job have changed and she is unable/unwilling to accommodate the change. You are firing her.

We are in MD, but our nanny filed for unemployment and our rate didn't go up. I was surprised.

She is eligible for unemployment if she was not discharged for gross misconduct and she did not quit. The Virginia Employment Center will send you a form about the separation.

Your state unemployment insurance rate will go up the next year based on the amount paid out. But, the rate is averaged out over 4 years, so the impact is going to be small. The federal unemployment tax you pay when you file your taxes will be unchanged, since it is not experience rated.
