When Wisconsin Assistant Attorney General Timothy Samuelson said tradition justified a ban on gay marriage, Judge Posner, a Reagan nominee, called tradition a “feeble” argument. Among other things, Posner said, "There was a tradition of not allowing black and whites, and, actually, other interracial couples from marrying. It was a tradition. It got swept aside. Why is this tradition better?”

Feel free to cite support for your "tradition" argument that enables you to differentiate this situation from the anti-miscegenation "tradition."

Unfortunately, the data on adoption is not good. Children fare no worse in their bio parents' homes. I would love to say that it is all the same, but it is not.

Gov. Edwin Edwards famously said that they only way he'd be disqualified from high office would be if he were caught in bed with a dead girl or a live boy. So they just take a dimmer view of the gay thing down there.

Sayeth the court:

"Louisiana 'has a legitimate interest ... whether obsolete in the opinion of some, or not, in the opinion of others ... in linking children to an intact family formed by their two biological parents.'"

So Louisiana is pro-family! As long as your family isn't the result of a same-sex union, a second marriage, adoption or IVF. Nice!
