You must wait 6 months to file in order to get jurisdiction in DC.
As soon as you move, however he can file for custody in your home state and use for the child to be returned.

I know they're expensive and funds are tight ... can someone cover it for you? So sorry ... I've been there (needing legal advice and not having the funds to cover it).

But it could save you a day/half day at the courthouse doing research at the self-help center ... then filling out the paperwork and returning in person. If you are starting a new job, you probably can't take off days. You may still have to do some of that but an attorney would tell you how to proceed. If you have to wait six months, you could do it in six months, take a few personal days then.
Does he have the funds to litigate if he wants?

There is no custody in play. I will initiate everything. I know I can do it in DC. Just wanted to know when.
Thanks All helpful responses

OP,
The PP's here are most likely not attorneys. It is possible that there are jurisdiction issues. Are you divorced or separated? Did you have his written permission to relocate with your child? This gets complicated ... Keep us posted and good luck.

you will need to file with whatever state handles your custody case

Have you run the numbers in the child support calculator? You can file yourself, ask for an expedited hearing. (Presumably you had permission in writing to relocate.) Good luck!

Welcome to DC. Nothing happens fast, especially here but as far as I know, you can file now. It will take even longer if the NCP lives outside of DC. Check out this info:

Hi
I just moved to DC. I was in the process of filing for support when this job came through. I did NOT file in our old state. Can I file in DC? do I have to wait 6 months? We need the money ASAP.
Thanks,
