I don't really like Jews. I would be uncomfortable if my kids asked me about the mezzuzah at their door. It's within my rights not to rent to them, right? Or I am afraid a Hispanic tenant might play that polka sounding music I hate. Or what if I can smell that nasty old lady Depenfs smell from my house.

Unfair is unfair.

She is being honest. It's her home...not some unit where she will never see or hear the people. If she feels uncomfortable to share her home with whomever, I think it's within her rights.

Yeah, sexual orientation isn't in the Fair Housing Act. But I bet there is a local statute. OP, people like you absolutely suck.

The sad truth is that people can legally discriminate on the basis of sexual orientation for housing and jobs in most states. So it depnds on where the OP is But hey, it's a states rights thing, right?!

OP this is really hitting me with a visceral anger that you are probably going to discriminate against this couple and get away with it. I'm a lawyer and I wish I knew this couple. I'd take the case pro bono and keep you so hog tied with a lawsuit that eventually you'd lose your house.

did you ask your previous tenants not to have sex in the apt, since the place is not totally soundproof? if your little kids hear noises of wild lovemaking is that OK for you as long as the couple of eterosexual? I used to be waken up in the middle of the night by the couple in the apt above ours (man and woman), the panting, moaning and even screaming was unbearable. I would have taken a quieter gay couple anytime.

if you really do not have a problem with that, why don't you just better soundproof your basement apartment, and then care about whether your renters are polite, clean, pay regularly and on time and not their sexual orientation.

Are you being unreasonable? That doesn't begin to cover it. I'd go with bigoted, although I'm sure others will have different opinions. Will you have a legal problem? I certainly hope so, given your implication that a gay couple is somehow a danger to your kids, or that it's inappropriate for your kids to see a gay couple.
