Maybe she is young, felt invulnerable, and this is her first pregnancy and she didn't realize how hard the lifting was or that she wouldn't be able to work up till her due date.

Maybe she thought that they'd be able to mover her to light duty if she needed it?

Maybe she really really really needed the job to pay the rent, and just took it hoping for the best?

Not that it matters, but I'm wondering why she would take on a position requiring heavy duty knowing that she is pregnant. There is nothing she can do but wait it out or find another job. She has not been fired, she is still within their system, so not discrimination.

OP, I just read the thread people are referring to which I had missed before. Is that you? If so, I am sorry people are being mean to you. If you are the sole breadwinner of your family and suddenly find yourself out of work, that is really, really hard. I imagine you must be very scared right now.

It does't sound as if you have any legal recourse, though. I wonder if you could contact some church groups or right to life people who help people with crisis pregnancies -- this certainly qualifies as one.

2 Pps...you need to read the original post last week posted by the actual woman. It is more detailed and there is no way she can file for discrimation. She works a job that requires heavy lifting and has not even been there 3 months so is still in a probationary period. Her doctor wrote a note pretty much saying she cannot do her current job. She has been put on suspension until they can find another job. No discrimation there. Sorry, but I don't understand why a new post was created. She just posted a week and a half ago.

OP, your sister should go to the local office of EEOC now and file a claim of discrimination. She does not need a lawyer to do this. She needs to do this quickly before her time runs out.

Didn't you already post this earlier this week? You were told emphatically that there is no unlawful discrimination if she cannot perform the duties.
