He has a bulldog attorney who loves to litigate and forces me to bleed money....I'm so tired and want this litigation to just end and settle.

The way you can get him to settle out of court is to provide him with the money he wants. Do you want to do that?

50/50 is standard/default - what is your argument against it as it relates to the kids? I don't know that him being a scumbag to you is going to be enough.

I think you need to play the long game here. I'm not sure fighting over 50/50 is part of that unless your attorney thinks you have the upper hand on that front. Seems like it just gives him an opening to demand a concession on another front. From the little bit you told us I'd focus my energy at this point on getting the best financial deal for you and for the kids' future (education) and getting the money locked down.

Do you have an attorney? Because they should be addressing all of these questions as well as advising you on what documentation you need to get together.

All of those things are factors and it sounds like he wants to fight, so the best advice you will get on here is to have a good attorney.

The default is 50/50, but why does he want it? It sounds like he's using more custody for leverage. However, could you wrap your head around 50/50 and let him figure out how to parent on his time so you don't get pushed into making a bad settlement on other issues? Even if he gets 50/50 to reduce child support, he probably won't use it all, based on your current situation. If you can prove the fake document, it will make the judge mad. That will certainly affect decision making on other issues if they go in thinking he's a fraud.
