You can do whatever you want. Getting caught has various problems.

Check local game laws and nuisance/pest laws if you want to stay in the bounds of the law. Sometimes there are exceptions for game animals doing harm to actual crops or property, such as squirrels damaging property, or deer or such eating planted crops. For ornamental plants, might be a gray area.

Funny, the deer don’t mess with my daisies, but they do like daylily flowers. You can spray deer repellent, but you must re-spray after any rain. If you forget, the deer take advantage.

I didn’t this once. They all disappeared so I set up a camera to catch the culprit. It was a fox!!! Not sure why it did this but it was pretty funny.

My mother-in-law used to garden and I have vague memories of her hanging Irish Spring soap in her garden to ward off deer. I have no idea if it was effective, or for that matter what kept it from dissolving on her plants when it was rained. I don’t know if it helped or hurt her garden, but I guess the garden was fresh and clean as a whistle.
