Yes and no here, dealing with not “rights” but “negative rights”, which most of the bill of rights is. Since they ruled that there is no constitutional right, the 10th amendment kicks in, therefore, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Trump wouldn’t sign it but even if he did, scotus would over rule it. Abortion is a state not inter-state/federal issue.

Democrats probably should pass a federal law banning abortion after 15 weeks, explicitly pre-empting and state laws. That would make abortion legal later than most of Europe, preempt states like Utah from banning it at less than 15, and be extremely popular with voters, and Reps could spin it that they were actually prohibiting late-term abortions. No need for a court to legislate from the bench, and the public gets what most want.
If I were Trump - gd forbid - I would absolutely try to get that through right away. But hopefully Rs won't have the House so they couldn't do it anyway.
I'm sure he and ol Secretary Brainworms will find a way to use the regulatory state to do some of this. We'll see if they are able - now that Chevron is gone. Anyway, it'll be interesting! Great for all the women who voted for him and the men who have dead wives and unwanted babies, too!

They don't need to pass a ban. Their plan is to start enforcing the Comstock act. It will function as a ban in practice because doctors will not be able to get the equipment and medications needed to perform abortions, and it will give Trump cover to say he didn't pass a ban.

Pro lifers might want to do a reality check and see how the Missouri referendum fared. Missouri passed one of the most restrictive laws in the nation, only allowing abortion in the most extreme of medical emergencies. It was overturned including by many Trump and Hawley voters. That kind of bill is a line that many Republicans will not cross.

The Dobbs decision did not leave the legality of abortion up to the states as everyone keeps saying. It left it up to “the people and their representatives,” which includes Congress.
