No, you don't in my experience. DC is in 7th grade now but accepted an out-of-consortiun spot in MSMC and was later invited for a criteria magnet. We chose MSMC and have been very happy.

No. Each list is maintained separately. My child was accepted to one criteria program, waitlisted at the other, and then got an invitation to the second one after accepting the first.
However, accepting first one seat and then the other prevents a student from going back to the first, as the second acceptance frees up the first seat for someone on the waitlist. A student always can elect to go back to their home school's base program, however.
Your child has some good luck! Would be happy for just one spot—our MS is known as pretty dismal. Thanks for the information.
