NP. I was once in a minor accident and felt fine at the time but then had some neck pain a few days later. With current understanding of whiplash and head injuries, my new rule is that after ANY accident I go in for a checkup. And I am hardly ever see doctors otherwise. It's not scamming--it's understanding how head/neck injuries can play out.

If you find out they lied about their insurance that's when you have to use your insurance. It's pretty common. That's why one of the first things you do when you are in an accident is take pictures of them, their car, their license plate, get info from witnesses, maybe even take pictures of their cars and license plates.

Your insurance will not ding you if other is at fault. They deal with other driver, other insurance. You don't have to talk to those. Have your insurance company deal with them and tell them not to call you.
They will sort out rental car hopefully you or at fault had that coverage. It's limited.
Cars can take a while to fix. You can take it to a dealer.

You need to calm your insurance. Hopefully the other party has insurance. Insist that their insurance pays for your rental car for the duration. If it’s bad, and you had a nice car or a leased car, you might want to look into getting extra for diminished value because when you sell they will definitely discount for an accident.
Collusion safety consultants. You can find him on Facebook. I’m sure every can walk you through it, but basically don’t just take whatever they offer you. Make the insurance company pay for the repairs directly and there will definitely be damage underneath that can’t be seen until they deconstruct the car.

Call your insurance immediately. If it is not your fault (which seems the case since other driver got a ticket) then your rate will not go up in future as a result. I sent pictures and video of the damage to my agent and received an estimate without ever leaving my home. Rental car would have been covered if I needed it. My wrecked car was unsafe to drive. I had a choice to repair with payout or take payout and release car.

-- Tell them you have pictures of the damage caused. Even better if you have pictures of the other person's car and license plate. Email those over to them. Depending on your coverage they will offer you a car rental. They typically send out an adjuster to see the vehicle in person and make an estimate on the damage and assist you in getting repairs

DD was rear ended really hard last year and we called our insurance who then dealt with the other party’s insurance. On our end it was easy. We only had to deal with our company who did a good job advocating on our behalf. Really it was one phone call, a trip to the body shop for an estimate (they let us choose one we liked) and then dropping the car back off for the repair. We opted out of the rental car because we didn’t need it but they offered that.
