It’s not illegal. You’d have no case and it would be a waste of time. Just upload and get your paycheck.
Your boss does sound flaky so look for a job elsewhere.
Also, and you need to hear this. Grow up. Time to get a real job at a real company and start learning how to be, how to operate as, and how to respond to little snafus (in the grand scheme this is a little snafu) as a professional.

For a small company, HR should have a process in place to override. They can provide sign-off for the flaky manager. Tell HR that you are not going to make your mortgage/rent payment (whether that is true or not), and they will figure out something for you. Also, is the company doing okay financially? Sometimes small companies cannot make payroll because receipts/invoices have not been paid. You probably need to move on soon to another gig.......

I worked for a small company right after college that did this. They ended up stiffing me about $1200.

They were in Old Town and had a mail slot on the front door. I literally can't tell you the number of times my friends and I finished the night bar hopping with a stop there to piss through the mail slot. Literally did this for years.

Is it a case of being a week or two late? Are you confident that back wages will be paid once the paperwork is done?

Personally, I highly value jobs that I actually like. If the money comes through within a week or two and you are not worried about them stiffing you, then I would consider sticking it out.

If it seems shady and they try to dock your pay once the paperwork goes through, then I would bail.

OP here. Thanks for the advice. Still no pay and crickets from higher ups. Moving on after contacting the State - so other employees are not caught in this web.

This. It's wage theft and your state DOL has a reporting line for it. Every time the paycheck is late, report. Boss will pay attention or get fined.

It could be managers fault entirely. Give owner a chance to know and offer you an explanation before you bail since you like the work.

Leave as soon as you can. If they aren’t meeting payroll, I’d question whether or not they are paying taxes including your withholding

Get a new job. I wasn't paid for years by three small businesses. One I couldn't even prove I worked there as they never cut me a check. It' not even the money, but I carry the hate with me even now over 20 years later.
I worked so hard for them. One of them said I should own half his business.
I didn't really have much choice as I was illegal, but I'm sure you are not.

Manager could be flaky with regard to processing the payroll but it could also be a cash flow problem. Managing both of these should be top priority. Ask HR how they can make sure it doesn’t happen again so they are more accountable to you and ask also if owner is aware of the multiple times this has happened.

I work for a small company. Immediate manager is super flaky. This is the 3rd time company has not paid me on time most likely because manager did not sign off and submit payroll. I've done all my work plus some. I've tried emailing manager and get ignored. Owner of company is not on sight and is running company from a far. Contacted HR via email who is displeased with manager. Anything else I should be doing?
PS I like the job.
