If he is located in Colorado and there past x days (he needs to look up), he has to taxes there. If working restaurant maybe he’s being paid cash and trying to avoid taxes, but if working for ski resort, presume they are filing with state— so state can go after son if not paying and he should be. Write this b/c reads he is is not thinking about this and you could help to let him know he needs to make sure what is owed b/c never good to owe $ to a state. Talk to your consultant friends - they often pay multiple state taxes for all the places they work in a given year.

It’s not a big deal to establish residency unless you’re trying to get instate tuition.

If he's working in CO I think he will have to pay Colorado income taxes. I work in one state but I have rented farmland in another and I have to file in both states.

The Colorado exchange website says you have to be a CO resident. He says he doesn't qualify because his lease is temporary employee housing.

Maybe that is the answer - that CO marketplace won't require residency proof, just declaration that is is one.

And, he knows the easy answer here is to establish CO residency = he is working that, but we are looking for ideas if he can't do that.


I wouldn't think the fact that he is in temp employee housing has anything to do with residency.

https://adcogov.org/establishing-residency --if you get a CO driver's license OR become employed in CO OR live there continuously for 90 days OR own or operate a business in CO you qualify for residency.
I imagine there's some flexibility here--like, if he is living/working in a ski resort and plans to return to VA and still has a VA drivers license, he could probably use VA as his residence (plus I think you have to provide ID, I've never done ACA myself but I would expect that to be the case). If he does use CO and then returns to VA, it's a change of status so he would qualify for special enrollment

Thanks very much for the advice

He has only been in CO for four months so last year paid VA taxes. I assume they are still taking VA taxes out of his paycheck He is transitioning to become CO resident so hopefully he will have that sorted out before he turns 26 and can buy from the CO marketplace

Maybe I should have provided more info but that would be a whole separate post in this forum 😂 - he is a college graduate but not following a traditional employment path. He is doing seasonal work at ski resort in CO and paid blogging for CO company while he and GF have thru hiked the Appalachian Trail and The Pacific Crest Trail - they are prepping to hike the Continental Divide Trail next year. So, you know, not always conducive to simple residency and insurance situations!

What do you mean he is not a resident? Is he trying to avoid paying taxes in CO?

A lot of the cheaper exchange plans don’t have national networks. So if he got sick or injured in CO, it might be difficult to find an in-network physician.

He needs to sign up for a plan in CO. And he needs to register his car and register to vote in CO.

Hope this is the correct forum.

My soon to be 26 year old child is coming off my health care insurance this year.

Trying to help him determine best option for his own policy.

He is working in Colorado (no benefits) and does not qualify as a CO resident. Still a VA resident.

Very healthy and active so needs very basic policy that includes emergency care anywhere and ideally covers preventative/minor care that is not considered out of network in CO.

Any thoughts or resources you can direct us to? Do young adults in this situation use telehealth services to stay in network?
