It’s entirely luck as a lot rests with the discretion of the officer.

If you get written up as reckless, you can go to court and a judge can knock it down to just speeding. But much much better to have it just written by the officer as a speeding infraction to begin with.

Never speed faster than 80 or more than 19 over in VA.

You got me curious OP, so I looked up fairfax county court records on speeding/reckless driving. Which one it is seems up to the officer. But almost all cases of 76-80 in 55 appear as speeding and almost all cases of 86+ in 55 appear as reckless

It is it's lawless now. The amount of people I see run red lights EVERYDAY. The people driving around with no headlights at night in pouring down rain the last few days and no cops in sight. It's anything goes.

The date of the violation, and the date the ticket was paid, were less than 2 weeks apart, and Christmas and New Years were both in those two weeks. Would a court date in such a short amount of time be possible? The court date listed on the page isn't until February--but then under "Result" it says "Waived" and then when you scroll down you can see it was paid.

I'm nosy and looked up someone in the VA court database. They have a speeding ticket that was 24 mph over the speed limit (69/45) but it was only an "infraction" ticket that they were able to pay online and waive the court appearance. I thought speeding more than 20 mph over the limit was reckless and a misdemeanor? Is it just the police officer's discretion?
