Are they suing? They seem rather wealthy and one would have thought they’d want to grieve in private and not have their kid’s contributory negligence litigated in a courtroom - especially after they allowed themselves to get exploited by Katcher during his losing campaign.

Well, Katcher admitted he wouldn't have done anything differently, so the entire thing made no sense as a campaign tactic. But I agree with you that I hope there is a civil suit that leads to a big payout for the victim's family.
To get back to OP's question, I think a good candidate could have won, but Katcher was not that candidate.
