A college could conceivably have student applications that are presented without race. However, private schools require parent interviews and student visits/interviews. Plus some schools request a student or family "picture."

While schools could be asked to remove the race designation from the original application, it would be very hard to the private school admissions system.

Can someone point me to a source that says this only affects schools that accept federal funding? I cannot find this.

It’s hugely driven by the universities research arms which take vast amounts of federal grant dollars. It’s how science works in this country. And as a result they are all tethered to constitutional restrictions on “government action.”

Taking a PPP loan does not mean you are a government actor, however.

So private schools can continue to discriminate.

If you cannot use race at Duke, why should it
be allowed at St. Alban’s?

Duke University accepts a whole lot of Federal funding. AFAICT, St Albans does not have any Federal funding.

Right now, yes.

But who in the world is going to file a lawsuit to know for certain? So that you can have the privilege of paying $50,000+ annually x 13 years? Hard pass!

Someone will have to file a lawsuit in order for you to find out.

Yes as long as they take no Federal funding. This is why Harvard was part of the case. It's private, but it takes federal funding.
