My aunt, who is not in Virginia, passed away 60 days ago.
Her son agreed to sell me her car, which will arrive in Virginia in mid-June.
He has power of attorney for his mom.
We are trying to figure out the easiest way to do the title transfer.
Issue:
When he tried to transfer the title to himself (in order to sell to me), he was told that he'd need to go to probate court. My aunt has a will, although when he talked to an attorney, was told it will take time to settle the estate. I need the car by mid-June at the latest.
Does the power of attorney expire when the person dies?
Can he sign the title over to me, and then I take the title + power of attorney to the DMV?
Will our bill of sale have my name and his name? (or my aunt's name?)
Someone suggested... Sign his mom's name, put a bill of sale with his mom's name. Will the state of Virginia check if the person is alive?
Can the signature be dated prior to his mom's death? (which will be 90 days by the time it arrives in Virginia). Don't you have to do the title transfer/registration within 30 days?
I've read the requirements with the DMV and did some googling but what would you do?
