This is really a legal question that should be answered by a lawyer.

That said, the photograph, painting, or drawing will have a copyright associated with it, assuming that it was not created before 1927.

There are also issues with the use of someone's likeness for commercial purposes. If you are selling something, you cannot legally (or ethically) use someone's image to suggest that that person endorses your product or service without his permission. Permission from the person depicted is not generally needed for news reporting or non-commercial use (though the copyright owner would need to provide permission for use of the picture).
