This seems like a pretty clear theft of trade secrets. (Customer lists are trade secrets.) will be interesting to see what Foxhall does.

There is no way for a private person to sue for a HIPAA violation.

Thank you, OP, for posting this. I saw a letter from Foxhall in my USPS informed delivery and I’m away for a few weeks so was curious (since I’m not pregnant and not due for an appointment anytime soon).

What she did was unethical at best.

I don't know anyone who went to her the "loved her" her reviews were bad online. They seem to have disappeared. Not a surprise Yelp and google do that all the time.

The patient records were not transferred. Just name, address, email, phone number, insurance. Not sure whether hipaa applies. It might

I never went to her but I know lots of people who did and they loved her. I think we should give her the benefit of the doubt. Maybe she thought it was just her patient list? Also, she’s old. Tech is probably not her thing.

I’m not too worried about it.

I thought I got a bill from them today and didn’t bother to open it yet. After seeing this, I opened it up and wow- I’m stunned. I can’t believe she did that. I’m so glad she’s out of the practice. In what messed up world did she think this was ok? The letter opens with ”…breaches of your Protected Health Information as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPPA”).”

I dunno. If I have a doctor, my relationship is with them, not the firm. I appreciate knowing where they land.

A mistake??? She stole the marketing list!

And used it! It wasn't "her" list of patients even..it was the firm's database.

Not concerned with Foxhall's handling of it but surprised the current employer allowed it. In most start-ups the Board would intervene and fire her.

I received the letter. I am satisfied with Foxhall’s handling of the matter.

First I was infuriated to learn today that an OBGYN at Foxhall whom I had never seen, stole a list of patients ( me included) , and their insurance providers and emails. Or as the letter that went out by hard cover to patients of the practice said " she retained a list"...then she gave the list to her new employer ( Alloy-where she is medical director) to use for marketing!

um....That is theft of IP.

Then I learn she is married to the former attorney general, Eric Holder.

Why hasn't she been fired from her current employer?

Did anyone else get this letter? It's very careful not to note the number of records..

She even has an endorsement quote from Michele Obama on her site...
