Doesn't sound like anything was stolen. Middle brother gave older brother the money. If he needed it so desperately why did he give it away?

For posters who don't do reading comprehension, legally, it means that the victim has no leg to stand on, since he willingly gave away his money to his brother. The brother is a garbage person, but I don't think there's any way a court of law can force him to reimburse his sibling, unless he actually signed a loan document (hopefully with a specific reimbursement date)...

My oldest brother didn’t receive the money. He waited for my younger brother to get the insurance payout and then proceeded to swindle the money out of my brother who is naive and unsophisticated and depressed.

I am a lawyer who happens to be licensed in the jurisdiction where the older brother currently lives. I am contacting other lawyer friends there to help me file suit against him. I’m just so disgusted and angry.

A veteran, no less! Has he developed some sort of mental disorder or does he have brain injuries from his stints in war zones?

I have 2 older brothers. Our mom died unexpectedly last year. She was very poor her entire life — single mom, never owned a house, etc. She had no debt, but also had little to no assets. The one thing she had was a modest life insurance policy worth $50,000. One of my brothers served as my mom’s primary caregiver for the past roughly 10 plus years. He took her to doctor’s appts, therapy, cooked, cleaned, drove her everywhere else, etc. My mom originally had the three of us as beneficiaries on the policy, but in recent years changed it to only my middle brother. It’s not money I needed so I didn’t care. My oldest brother also has his own income stream from being 20 years retired military plus full 100% disability payments after being deployed to a war zone 8 times during his career. My oldest brother raised a stink when I said I would handle the policy/money and make sure our other brother had the proper account etc. So I left it alone and let them sort it out. I found out today that my oldest brother swindled every dime of that money out of my younger brother. Every last dime. My brother naively caved and gave him whatever the other brother asked for until he had no money left. My brother is now left with nothing. He had no savings, no retirement money. Literally nothing. The oldest brother pressured him into giving away the money — telling my brother that it wasn’t his, etc. and frankly taking complete advantage of someone who was (and still is) severely depressed after losing his best friend who happened to be our mom who he cared for so dearly. I’m furious at my brother. Why are people like this?!?!
