Maryland’s top court has held that a teen who sent a video of herself performing a sex act on another teen to two of her friends distributed child pornography and displayed obscene content to other minors.
The teen, called S.K. by the court, attended a Charles County high school. The 16-year-old female had a group chat on her cellphone for text messages with two friends. S.K. sent a one-minute video of herself performing a sex act on a young man to her group chat friends using her cellphone. After a falling out among the trio, the video was distributed to other students at the school and shared with the school resource officer.
Five Fairfax County students are facing nine child porn charges and one charge for unlawful filming tied to a sexting case in which the students traded naked pictures of female students.

Sexting is the act of sending sexually explicit photographs or sexual text messages electronically which are primarily transmitted between cell phones.
Teens are increasingly engaging in sexting without adequately understanding its consequences. The taking and/or sending of sexually explicit photographs electronically can be considered a crime.
There have been many articles in the news about the dire consequences of teens sexting each other including suicides and criminal charges.
In addition to taking and posting these photos, an alarming number of teens, 39%, say they’ve sent sexually suggestive text messages. This, in spite of the fact that 73% "said they knew sending sexually suggestive content can have serious negative consequences."
Technically speaking, activity related to taking provocative photos can be considered to be the manufacturing and distribution of child pornography if it contains sexual conduct or is intended for the purpose of sexual arousal. While the teens taking these pictures of themselves may only intend for it to be seen by their friend, it is often distributed to others with unintended consequences.

Teenagers under 16 in Maryland who simply possess a sexually explicit image or video of another teen on their phones could face dire consequences: up to five years in prison and/or a fine of $2,500.
Sexting is the act of sending sexually explicit messages, photos or videos using a phone. In a study released by the National Center for Missing and Exploited Children, one in five teenagers sexts, 80% of whom are under 18.
It is illegal in Maryland to photograph or film a minor engaged in sexual conduct, to distribute images or videos of a minor engaging in sexual conduct or to use a computer to publish information for the purpose of soliciting sexual conduct of a minor.

Sexting has become an increasingly large problem in the past few years, ranging from the 2010 scandal at Pyle Middle School to even a few minor cases at CHS, according to some students.According to assistant principal John Taylor, it is hard to keep statistics on the number of students involved in sexting since most cases occur outside of school.
“It’s not technically a school infraction, though we end up dealing with consequences in school,” Taylor said.
Not only are the effects of sexting harmful to one’s reputation, but with the police cracking down on the enforcement of child pornography laws, the penalties can be severe. According to federal law, the United States defines child pornography as “the visual depiction of minor children under the age of 18 engaging in sexually explicit conduct.” Even a nude picture of a girlfriend or boyfriend can be considered child pornography.
It only takes a few clicks of a button to rack up numerous counts of child pornography production, possession and distribution.
