of course it matters.  it matters for intent which speaks to what is an appropriate punishment. if I am in a drunken hookup, and both parties are REALLY DRUNK, it may take more than a split second to realize the other person has passed out.  I know I had dates in college where one of us passed out and the other rolls over and goes to sleep and waits until morning.  But I wouldn't hold it against my partner if they didn't realize I had passed out for 5 seconds![/quote]
