[/quote] +1. I live in NYC, am a (non-white, since that apparently matters) lawyer, and have been terrorized by mentally ill people on the subway more times than I can count. I can tell you on the publicly available facts there is no way I would vote to convict here, and I hope Penny is acquitted. I really don’t think that a jury comprised of NYC residents would convict. I’m in NYC and the tone is off right from the start. The 3rd paragraph begins, “Across social media, lamenting onlookers privileged enough to think America’s racism dissolved after the protests of summer 2020 have asked how this could happen.” This is some of the crassest, most MANIPULATIVE BS - and there is no one who legitimately thought the wand was waved in early September 2020 and poof! Bye-bye racism! My hand to all gods, there are people who want to make every unstable person very much into a resurrected Christ, where the fear one may at having her hair grabbed and yanked down to force her to stay in a train car is the problem - not the act of forcing a smaller person to interact with an out of control lunatic. It knows its niche and serves up what its readers want, which is a steady diet of accusations of racism and a celebration of victimhood. If you want a more objective analysis, you’d never look there in the first place.
