If UT is using the holistic process to admit (primarily) black athletes, they are misleading the Supreme Court by not saying so, and likely going to pay for that silence. And rightly so. You don't make fun of the Constitution in order to get a good college team.
What? In every article I have read about this case or press release from the university has not hidden that their holistic review includes athletes, as well as a number of other considerations. It includes everything that is mentioned above (athletics recruits, out of state students, students in the arts, students who have a unique talent but do not qualify under auto admit, students with exceptional leadership experience etc.) They also mention that racial, ethnic, and socioeconomic status as something that can be taken into consideration, although that is just one of many things that they look at in their holistic review. Perhaps there is a hypothetical case where under holistic review the tie breaker was race between two students with similar SAT scores and grades who did not qualify under auto admission. Since the evaluation is holistic and designed to account for those students who do not make the cut under the standard review, there is a degree of subjectiveness in terms of who the school chooses to admit, and it would be pretty difficult to prove that this "tie breaker" situation occurred, since every individual applying I'm sure has unique family backgrounds, preparation in terms of courses, extracurriculars, that can be considered beyond their grades and SAT scores. But there is no clear evidence this that this tie breaker situation occurred for Abigail Fisher. But of course, affirmative action fires people up, so people don't look into the specifics of the case.
