Custody is for the parents. Many custody agreements have a right of first refusal clause, where if the parent with custody is going to be gone longer than X number of hours, that parent must first offer the time to the other parent before engaging a sitter or other person to watch the child. What does your custody agreement say? Consult an attorney about how to document and proceed on this, very legitimate problem. But, be aware, if you have this clause, you have to be ready for your ex to dump your child on you without much notice and you have to receive the child without complaining that ex is falling down on his parenting time.
