We do not send people to prison without due process because someone can lie ([i]like you just did,[/i] having absolutely no knowledge about all the Venezuelans) and innocent people could end up in a concentration camp. I will repeat: Our Constitution guarantees due process so that liars cannot send innocent people to concentration camps for life. If you have evidence, you would use the court system. Not trying to be argumentative but how do you know whether or not these individuals were members of TdA--or any other gang? The administration did not provide any evidence. THEY DON'T FEEL THEY HAVE TO. That's part of the problem. Another thing that's happened on this front is that recently the Supreme Court issued a temporary injunction halting the deportation of a group of Venezuelan migrants detained in Texas under the Alien Enemies Act. This action came in response to an emergency petition filed by the American Civil Liberties Union (ACLU), which argued that the detainees had not been given adequate notice or the opportunity to contest their removal in court. In its brief, unsigned order, the Court stated: “The government is directed not to remove any member of the putative class of detainees from the United States until further order of this court.” This directive effectively pauses the deportations until the Court can further review the case. Justices Samuel Alito and Clarence Thomas dissented from this decision. Previously, on April 7, 2025, the Supreme Court addressed the procedural aspects of such deportations. In that ruling, the Court emphasized that individuals detained under the Alien Enemies Act are entitled to: “Notice and an opportunity to challenge their removal.” Obviously these action by the SC are not the final word on the matter, but they do show that the SC court is interested in due process--for now. [/quote]The administration does not have to provide evidence, unless there is a habeas claim. That is what the ACLU is bringing before the Supreme Court. The Supreme Court already ruled the government has to provide notice, which it did.[/quote]
