[/quote] Technically yes bc you have neither committed the bahvior or act that could be classified as criminal (have not left the store without paying) nor do you have the correct intent (intent to stral)- to commit a crime or at least be found by a court guilty of committing a crime the prosecutor would need to prove both beyond a reasonable doubt- act and intent.
