It doesn't matter that the trainer is not in a regulated industry -- if you have celebrity clients who value privacy, then you absolutely are not free to just blab sensitive personal info to anyone who asks. The trainer's NDA probably even specifies that he may not share info about weight or weight-loss with others. And Baldoni absolutely should have known this. And yes, in harassment cases, asking about personal info like an employee's weight could be considered part of a campaign of harassment. Especially in an industry like Hollywood where actresses come under a lot of scrutiny for their weight and where actresses have been denied roles or fired for their weight. If they show that Baldoni and/or others at Wayfarer were pressuring Lively about her weight and losing baby weight prior to filming, this would absolutely contribute to proving sexual harassment. [/quote] The trainer’s NDA is with Blake, not Baldoni. Baldoni can ask any question he feels is essential to his training. He would’ve asked the same question had it been a trainer with no connection to Blake at all. Any good trainer could look at Blake and estimate her weight based on height and appearance.
