OP, if you noticed the flag, it's highly likely other people notice it, too.  My guess is that someone will complain.  And that's probably why he put it up -- he's trying to provoke someone, so he can then claim that he's being discriminated against.  That's exactly why HR's response will be to make a rule limiting what everyone can put on their desks.
