Well that's because the OP misstated the law.  Penalty up to $125,000 is to cover any and all acts of discrimination.  So you are not going to get a $125,000 fine for one time referring to a person this way. So, you--a female in this scenario--work in your office for 5 years. Every day for five years, you encounter a certain coworker several times. During each encounter, this coworker goes out of his way to call you "he," "sir," or "him." You've asked him repeatedly not to, and he continues to do so. Pointedly. And nastily.
