Thus Title IX the federal statute takes precedence. The 4th Circuit’s attempt and creating public policy from the bench [b]will be overturned.[/b] Most school districts in VA understand this and have adjusted their policies accordingly. FCPS and others in NOVA will continue to support the unsupportable. The least they can do is join forces to save taxpayer money on legal fees. If they changed their policy, wouldn’t that open them up to lawsuits for violating the 4th District’s ruling? [/quote] Other VA school districts don’t have these policies, yet are not being sued.
