In your situation it would be extremely, extremely, unlikely, practically 0. It's as the prior poster said, schools are forced by the state to send the threats, even if a kid has 0 school issues and perfect grades. It would only lead to court for actual negligence and poor grades, and even that's unlikely.

In fact parental rights are quite strong in the US. Parents are even allowed to "pimp" their children on Instagram without any kind of repercussions, as discussed in this recent horrific nytimes story:
