This was not his first offense. He was charged with MISDEMEANORS. Let that sink in. Sexual abuse of a child and beating someone so badly they are hospitalized are misdemeanors in DC. [/quote] You raised a good point, I didn't even pay attention to the fact that the charge for this latest occurrence, which involved exposing himself to children, was a misdemeanor charge. That's likely because DC does not separate "exposure" to a minor vs. an adult - it's part of the same offence. Anyone know if this would have been updated and how with the previously proposed DC code that got tanked in congress? Moving forward, this needs to be fixed - it should be a separate, and more serious, offense for engaging in this behavior to a minor. Current applicable DC code: "Code of the District of Columbia § 22–1312. Lewd, indecent, or obscene acts; sexual proposal to a minor. It is unlawful for a person, in public, to make an obscene or indecent exposure of his or her genitalia or anus, to engage in masturbation, or to engage in a sexual act as defined in § 22-3001(8). It is unlawful for a person to make an obscene or indecent sexual proposal to a minor. A person who violates any provision of this section shall be guilty of a misdemeanor and, upon conviction, shall be fined not more than the amount set forth in § 22-3571.01, imprisoned for not more than 90 days, or both."[/quote] USAO will likely up the assault charges to Felony Assault at least, perhaps Aggravated Assault if they can show the one teacher was knocked unconscious.
