This happened to my cousin. He went on a work trip and came home to his wife having left and moved into a sublet apartment. The judge considered her to have abandoned the family and the marital home. She got screwed in the divorce settlement and my cousin (the father) got primary physical custody and the ex-wife lost claim to the marital home. This was in Virginia about 10 years ago.[/quote]
