Let me let you in on a little secret:  When they said "unconstitutional" they were just using the word in the same way that a 5 year old would use something like "poopyhead."

"Obama's unconstitutional policies" = "Obama's poopyhead policies."

They referred to the Constitution but there was no Constitutional argument.  A constitutionality argument would have and should have been pursued in the courts - but you'll note that virtually none of the things the talking heads declared to be "unconstitutional" were - and that the handful of legal challenges that did go to the courts did not hold up to scrutiny.[/quote]
