I think you're confusing the state terrorism charge with what makes the federal charges a capital offense- the use of a silencer.

They've got a pretty clear path to it, and it doesn't require them to prove any more than they otherwise would. Just the use of a silencer, which they would want to do because that's how the federal charges get to mandatory life in prison.[/quote]
