They’re voluntarily terminating the conservatorship. Let’s see where this is in five year. The Tuohy’s will remain successful, Oher will be broke.
How voluntary is something when you have to be sued to do it?
I thought he was suing them for $, not to have the conservatorship removed? It sounds like they haven’t really ever done anything with the conservatorship since he went to college. But I’m sure it will all come out now. They didn’t really make much money on the actual movie (Hollywood Studio greed), but maybe he is entitled to a percentage of their earnings for things like motivational speaking gigs they got after the movie came out? It’s a big grey area.
He wants the conservatorship removed and a full forensic accounting of said conservatorship. He is clearly entitled to that and if they had nothing to hide, this would be cut and dried. Singer's involvement makes me think it is not, though his involvement might be due to the damage this does to their brand. The monetary figures express the suspicion that they swindled him out of his fair share of assets generated by his story and likeness, not part of the petition per se.
Right. Only one thing I would change from what you said. In the first instance it is not a forensic accounting. It will be an accounting done by Sean. The Michael can look at it and test and probe. The he may ask for an outside firm to come in and do an accounting. But here I think Sean is likely to say there is no accounting because no money ever came in or out. That the conservatorship did no business. Then Michael will need to come back and say that is crap and I want to see your assets and income to see if I am owed money. I think that request will be denied by the judge unless Michael can point to particular money he did not get. If they show they gave it to him or put it in a trust for his kids then the case ends. One other thing. I do not think the order establishing the conservatorship is out. We need to see what it said. They are all not the same. It may be broad like the Spears one or quite narrow. That will be important to find out.
Here's the pertinent part of the conservatorship:
It further appears to the Court that the said Oher, though having reached the age of 18, is enrolled in high school for the coming year and i scheduled to graduate in May, 2005. It further appears to-the Court that it is Oher's desire that the Petitioners be recognized as his conservators until terminated by an Order of this Court. It further appears to the Court that Petitioners have provided and will continue to provide assistance and guidance as necessary. It further appears to the Court that the Petitioners and the said Oher have enjoyed a close and familial relationship for many years and further that the said Oher has lived in the home of the Petitioners and wishes to continue to do so. It further appears to the Court that it is· in the best interest of the said Oher that the Petitioners be appointed as his conservators of the person. It further appears to the Court that Oher has no estate and further that he is dependent upon the Petitioners for his support and financial needs. It further appears to the Court that the Petitioners have sought no support or assistance from any agency for the financial needs of Oher and are financially able to provide for him. It further appears to the Court that Oher resides in the home of the Petitioners along with the Petitioners' natural children. It further appears to the Court that Oher has no known physical or psychological disabilities. It further appears to the Court that it is in Cher's best interest to appoint Sean A. Tuohy and wife, Leigh Anne Tuohy as conservators of the person and that they should have all powers of attorney to act on his behalf and further that Oher shall not be allowed to enter into any contracts or bind himself without the direct approval of his conservators. It further appears to the Court that any an all medical decisions shall be made by the conservators who will have full and complete authority to make these decisions and educational decisions in Oher's behalf. It further appears to the Court that-the Petitioners should have complete and full access to all medical and school records as if they were the natural parents and guardians of Oher. IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the Petitioners, Sean A. Tuohy and wife, Leigh Anne -Tuohy be and are hereby appointed as the conservators of the person of Michael Jerome Williams, Jr., a/k/a Michael Jerome Oher.
